(B) Some components of the software are provided under various open source licenses that have been provided to Kony. You can only modify or replace these open source components. provided that (i) the resulting software is used on a single computer instead of the unchanged software; and (ii) comply with the terms of this license and all applicable licensing conditions for the use of open source components. Kony is not required to provide technical or technical assistance for the resulting software. 11.1 Definition of confidential information. For the purposes of this Agreement, “Confidential Information” means all of our business or technical information that we provide to you or that we make available to you under this Agreement, whether in writing, orally or otherwise, including through computer programs, code, algorithms, data, know-how, formulas, processes , ideas, inventions (patentable or not), circuit diagrams and other technical, commercial, financial and product development plans, the names and expertise of staff and consultants, as well as client lists. For the purposes of this contract, the source code of our software is considered to be our confidential information, whether or not it is identified as such. (a) assessment license. Subject to the terms and conditions of this Agreement, Ververica grants the Customer, during the evaluation period, a non-exclusive and non-transferable right (except under Section 14.5), a global and license (without sublicensing), to install and operate the Ververica product exclusively in a non-production environment to assess internally the suitability of the Ververica product to the commercial needs of the customer.
3.2. The customer is solely responsible for the maintenance of all software and hardware (including, but not limited to network systems) necessary to enable the Customer to properly exercise the licenses issued there. These include the minimum requirements set out in the documentation. 13.8 No other conditions. This agreement is the only agreement between us, and the terms and conditions of any order, written conditions or any other document you provide to us contain conditions different from those of other conditions, contrary to or in addition to the terms of this Agreement, are hereafter refused by CoreOS and are invalid and ineffective.
